 This Privacy Policy applies to all personal information collected by ViaPay Pty Ltd (we, us or our) via the websites located at viapay.com.au and viapay.ai (collectively, Website).

The kind of personal information we collect depends on how you interact with us. It may include:

  • Payment and transaction details (including bank or credit card information, billing information);

  • Device information, browser type, IP address, and activity logs;

  • Information about your customers (e.g., vehicle owner contact details, booking details, payment activity) when you use our platform to process or manage transactions.

We do not knowingly collect personal information directly from end-consumers unless they engage with our Services directly (e.g., via checkout, SMS and email, or payment links sent on your behalf).

As defined under the Privacy Act 1988 (Cth):

  • Personal Information is any information or opinion that can identify you or make you reasonably identifiable, regardless of whether it is true or recorded.

  • Sensitive Information includes information such as racial or ethnic origin, political opinions, health data, etc.

We generally do not collect Sensitive Information. Where we do, it will only be used:

  • For the primary purpose for which it was collected;

  • For related secondary purposes; or

  • With your express consent or as required by law.

  1. How we collect your personal information

We may collect personal information:

  • When you provide it to us directly (e.g., when signing up, entering payment details, using the Website or related apps);

  • Automatically, through cookies, analytics tools, or tracking pixels on our Website;

  • When your customers input information via payment or booking links we generate on your behalf;

  • From third-party services integrated into our platform (e.g., Payment, Booking, Workshop Management and Accounting Software);

  • From public sources or third parties, where authorised or required.

Cookies may be used to enhance your user experience but do not typically identify you personally unless combined with other data.

  1. Purpose of collection

We collect your personal information to:

  • Provide, maintain and improve our services;

  • Enable secure transactions and payment processing;

  • Support workshop communication with end-customers;

  • Troubleshoot, analyse usage, and conduct internal reporting;

  • Send service updates, promotional material, or customer support communications.

We may disclose personal information to trusted service providers (e.g., cloud hosting, payment processors, SMS platforms) only for the purposes outlined above. These providers are contractually obligated to handle data securely and in compliance with applicable privacy laws.

By using our Website or Services, you consent to receive direct marketing communications, which may include email, SMS, or in-app messages. You can opt out at any time via unsubscribe links or by contacting us.

  1. Security, access and correction

We take reasonable steps to protect personal information from unauthorised access, disclosure, or misuse. Information is stored securely and destroyed or de-identified once it is no longer required, usually after a maximum of seven (7) years for compliance purposes.

  1. Complaint procedure

If you believe we have breached your privacy rights, please contact us via the details below. All complaints will be investigated by Joshua James, our privacy officer. If you are not satisfied with our response, you may escalate your complaint to the Office of the Australian Information Commissioner (OAIC).

  1. Overseas transfer

ViaPay does not routinely transfer personal information overseas. However, some of our service providers (e.g., cloud or payment infrastructure) may store data in jurisdictions outside Australia, including the United States. In such cases:

  • We ensure appropriate safeguards are in place (e.g., standard contractual clauses); and

  • You acknowledge that we cannot guarantee foreign service providers will comply with Australian Privacy Principles.

  1. GDPR

Our Website and Services do not target individuals in the European Union, and we do not monitor their behaviour. As such, the General Data Protection Regulation (GDPR) does not apply.
